Understanding Changes In State Laws

Starting February 21, 2025, Michigan employers must comply with the Earned Sick Time Act (ESTA), which significantly expands on the current Michigan Paid Medical Leave Act (PMLA).

Under ESTA, all employers, regardless of size, will need to provide up to 72 hours of sick leave annually, marking a shift from the PMLAs limited scope. Notably, ESTA applies to all employees, including part-time, temporary, and remote workers, and broadens the definition of “family member” to include domestic partners and others with close familial ties.

ESTA also includes stricter anti-retaliation provisions and allows employees up to three years to file claims for violations, compared to six months under the PMLA.

Michigan businesses should review and adjust their leave policies and administrative procedures to ensure compliance with these upcoming regulations.
